Our Services use artificial intelligence to assist in creating job application materials. While we strive for quality and accuracy, you are responsible for reviewing and approving all content before submission to employers.

Eligibility

You must be at least 18 years old to use our Services. By using xApply, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

User Accounts

Account Creation

To access certain features, you must create an account. You agree to:

  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

Account Termination

User Content and Ownership

You retain ownership of all content you provide to xApply, including your resume, work history, skills, and other personal information ("User Content"). By using our Services, you grant us a limited license to use, process, and display your User Content solely to provide and improve our Services.

Generated Content

Content generated by our AI tools based on your User Content (such as customized resumes and cover letters) remains your property. You have full control over how this content is used and distributed.

Content Accuracy

You represent and warrant that your User Content is accurate, truthful, and does not infringe on the rights of any third party. You are solely responsible for the accuracy of information submitted to employers.

Acceptable Use Policy

You agree NOT to:

  • Use the Services for any illegal or unauthorized purpose
  • Submit false, misleading, or fraudulent information
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Use automated systems (bots, scrapers) without permission
  • Interfere with or disrupt the Services
  • Spam employers with mass applications
  • Share your account credentials with others
  • Reverse engineer or copy our software or algorithms

Subscription and Payments

Pricing

We offer both free and paid subscription tiers. Pricing information is available on our website and may change with notice. Price changes will not affect current subscribers until their next renewal period.

Billing and Renewals

Paid subscriptions automatically renew unless canceled before the renewal date. You authorize us to charge your payment method for recurring subscription fees.

Cancellation and Refunds

No Employment Guarantee

xApply is a tool to assist with job applications. We do not guarantee employment, interviews, or any specific outcomes. Job search success depends on many factors beyond our control.

"As Is" Basis

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

AI-Generated Content

While our AI strives for quality, it may occasionally produce errors, inaccuracies, or inappropriate content. You are responsible for reviewing all generated content before use. We are not liable for consequences of using AI-generated content.

Third-Party Services

We are not responsible for third-party websites, services, or employers you interact with through or because of our Services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, xApply AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES.

Our total liability for any claims related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless xApply and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your violation of these Terms, (b) your User Content, (c) your use of the Services, or (d) your violation of any rights of another party.

Dispute Resolution

Arbitration

If informal resolution fails, any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class actions or class arbitrations.
